Aktion21 - pro Bürgerbeteiligung: Partizipation in Vienna

The City of Vienna has committed itself in international agreements, in particular by adopting the Aalborg Charter, to apply the instruments originating from it like Agenda 21 or the Aalborg Commitments. Among them are forms of participation which are explicitly mentioned in these documents (e.g. Agenda 21, Chapter 23, 27 and 28).

Numerous Viennese citizens’ groups, which formed due to the failing of the existing forms of participation, proposed their cooperation to those responsible in the City to improve the situation. This offer was categorically declined by City Councilor Mr. Schicker, by saying that the forms of participation existing in Vienna would absolutely account for international commitments and need no reform.

As a result, over 20 Viennese citizens’ groups have united to form a non-partisan NGO called aktion 21 – pro Bürgerbeteiligung (referring to the Johannesburg Call of the World UN Summit of Sustainable Development 2002). Their unique objective is to accomplish a well-working participation in projects in Vienna.

For such activities, the City of Vienna mobilizes funds granted by the EU. However, it openly refuses the aktion 21 – pro Bürgerbeteiligung NGO to share in these funds. Yet, these would only be used for participation processes that do not receive any support due to the repressive handling of the participation instruments by the City of Vienna. These are in particular:

> projects in districts where there is neither a Local Agenda 21 nor another form of participation;
> projects about which the population received information only shortly before or even after realization; information which could result in the wish to participate;
> projects which those responsible in the City have found “inapt for participation” or are virtually treated as such (in particular large projects which have been developed by agreement with the City of Vienna);
> projects against which any political party has taken a critical stand;
> projects which have been agreed upon on a higher level and have to be implemented, despite a conflicting legal situation, by public officials who are under political pressure.

aktion21 - pro Bürgerbeteiligung acknowledges participation as a completion of representative democracy. It primarily considers participation as a possibility to find out the opinion of the citizens concerned prior to planning activities in the community, to produce arguments, to respond to them and to push planning processes based on the results found in these discussions. This should prevent fundamental confrontations and raise the general acceptance of the solutions finally found.

The citizens willing to participate who have united to form aktion21 - pro Bürgerbeteiligung regret that the present City Administration is not ready to conduct a productive dialogue about the legal framework for a well-working participation. However, they will obviously continue their attempt to reach this target and they believe that the democratic process of maturing, which is taking place all over Europe, won’t stop at Vienna after all.

Die Stadt Wien hat sich in internationalen Abkommen, insbesondere durch ihren Beitritt zur Charta von Aalborg zur Anwendung der aus ihr entspringenden Instrumente wie der Agenda 21 oder der Aalborg Committments verpflichtet. Dazu zählen auch Formen der Partizipation, die in diesen Dokumenten ausdrücklich erwähnt sind (z.B. Agenda 21, Chapter 23, 27 und 28)
Zahlreiche Wiener Bürgerinitiativen, die sich wegen der Unzulänglichkeit der vorhandenen Partizipationsformen gebildet hatten, haben den Stadtverantwortlichen eine Zusammenarbeit zur Verbesserung der Situation vorgeschlagen. Dieses Angebot wurde von Stadtrat Schicker kategorisch mit dem Bemerken abgelehnt, die in Wien vorhandenen Formen der Partizipation trügen den internationalen Verpflichtungen vollauf Rechnung und bedürften keiner Reform.

Über 20 Wiener Bürgerinitiativen haben sich darauf hin als überparteiliche NGO unter dem Namen „aktion 21 – pro Bürgerbeteiligung“ (mit Bezug auf den „Aufruf von Johannesburg“ des weltweiten UN-Gipfels für nachhaltige Entwicklung 2002) zusammengeschlossen. Ihr einziges Ziel ist, in Wien eine funktionierende Partizipation bei Projekten in der Stadt durchzusetzen.

Die Stadt Wien spricht für solche Aktivitäten finanzielle Mittel der EU an. Sie scheut sich aber nicht, der NGO aktion 21 – pro Bürgerbeteiligung den Wunsch nach Teilhabe an diesen Mitteln rundweg abzuschlagen, obwohl deren Verwendung einzig und allein für jene Partizipationsvorgänge erfolgen würde, die bei der repressiven Handhabung der Beteiligungsinstrumente durch die Stadt Wien ohne jegliche Unterstützung bleiben. Dies sind insbesondere:

> Vorhaben in Bezirken, in denen es weder eine Lokale Agenda 21 gibt, noch eine andere Partizipationsform zur Verfügung gestellt wird,
> Vorhaben, bei welchen die Bevölkerung erst knapp vor oder überhaupt erst nach „Verrechtlichung“ Informationen bekommen hat, die zum Wunsch nach Partizipation führen könnten,
> Vorhaben, die von den Stadtverantwortlichen als „partizipationsuntauglich“ befunden oder faktisch so behandelt werden (insbesondere Großprojekte, die im Einvernehmen mit der Stadt Wien entwickelt wurden),
> Vorhaben, zu denen irgendeine politische Partei kritisch Stellung bezogen hat,
> Vorhaben, die auf höherer Ebene paktiert wurden und selbst bei entgegenstehender Gesetzeslage von der unter politischem Druck stehenden Beamtenschaft durchgezogen werden müssen.

Aktion21 - pro Bürgerbeteiligung bekennt sich zur Partizipation als Ergänzung der repräsentativen Demokratie. Sie versteht Partizipation primär als Möglichkeit, im Vorfeld von Planungen in der Gemeinde die Meinungen der betroffenen Bürgerinnen und Bürger zu erkunden, Argumente vorzubringen, auf diese einzugehen und Planungsprozesse auf der Grundlage der dabei erzielten Diskussionsergebnisse voranzutreiben. Dadurch sollen fundamentale Konfrontationen vermieden werden und die allgemeine Akzeptanz der schließlich gefundenen Lösungen erhöht werden.

Die als aktion21 - pro Bürgerbeteiligung zusammengeschlossenen partizipationswilligen Bürgerinnen und Bürger bedauern, dass die gegenwärtige Stadtregierung nicht bereit ist, mit ihnen einen produktiven Dialog über die gesetzliche Verankerung einer funktionierenden Partizipation zu führen. Sie werden trotzdem auch weiterhin unbeirrt versuchen, dieses Ziel zu erreichen und vertrauen darauf, dass der demokratische Reifeprozess, welcher in ganz Europa stattfindet, letzten Endes auch vor der Stadt Wien nicht halt machen wird.
